ORDER:
In the G.Os 1st 2nd and 3rd read above, orders were issued dispensing with the Scheme of Compassionate Appointment to the dependents of Government employees who retired on Medical Invalidation, consequent to the judgment Dated: 12-10-2001 in W.P.No. 13489/2000 and batch of High Court of Andhra Pradesh wherein it is held that the Scheme is unconstitutional and violative of Article 16 of the Constitution of India.
2. In the G.O. 4th read above; orders were issued to consider appointments on contract basis to the post of Panchayat Secretary with a Basic Pay of Rs. 2,870/+ H.R.A. + D.A. to the dependents of Government Employees who retired on Medical Invalidation before issue of G.O. Ms. No. 202, General Administration (Ser. A) Department, Dated: 27-04-2002.
3. In the representation 6th read above, the Joint Action Committee of Employees, Teachers and Workers, Andhra Pradesh has stated that for appointment to the post of Panchayat Secretary, "Intermediate" is the academic qualification prescribed as per G.O. 5th read above and that only those who possess the said qualification have the benefit of the appointment on contract basis to the post of Panchayat Secretary. The Joint Action Committee has informed that the dependents of employees who retired on Medical Invalidation before 27-04-2002and who possess the academic qualification of 10th Class and below cannot be considered for appointment for the posts of Panchayat Secretaries. It has requested the Government to consider the cases of persons who do· not have "Intermediate" qualifications for appointment in other suitable posts.
4. Government, after careful consideration, have decided to consider the above request and order as follows;
(i) Cases of dependents of Government Employees who retired on Medical Invalidation before 27-04-2002 as per the procedure prescribed and who possess 10th Class academic qualification only, be considered for appointment to the post of Executive Officer, Special Category – V (Panchayat Secretary) on contract basis in relaxation of academic qualification of Intermediate as per orders issued in the G.O. fifth read above.
(ii) Cases of dependents of Government Employees who retired on Medical Invalidation before 27-04-2002 as per the procedure prescribed and who possess 7th Class academic qualification only, the following ex-gratia amount shall be paid in lieu of appointment on contract basis.
Dependents of Gazetted Officers - Rs. 40,000
Dependents of Non-Gazetted Officers - Rs. 30,000
Dependents of Class-IV Employees - Rs. 20,000
5. The Panchayat Raj and Rural Development Department will issue further instructions on item (i) under para 4 above.
