ORDER:-
Vide reference cited above, In case of Compassionate Appointments to the dependents of deceased Government Employees, the dependents can be considered for compassionate appointments at the local area to which the applicant belongs as a local candidate, or at the place of working of the deceased employee as per the choice of the applicant. In case the applicant is a local candidate at the place of working of the deceased employee, the applicant should be considered as local candidate, otherwise the applicant should be treated as a non-local candidate for the unreserved vacancy only. Some of the employees appointed under the category of compassionate appointment have been appointed in a cadre to which they are not local.
2. The Government have examined the issue and hereby order that such of the employees who were appointed under compassionate appointment in a cadre to which they are not local, be given an opportunity to opt for transfer to their local cadre. Such inter local cadre transfers are to be issued in public interest. The following conditions should be fulfilled availing this facility: -
(i) employee should opt for inter local cadre transfer;
(ii) employee shall be holding a localized post as on now;
(iii) there should be a clear vacancy in the local cadre for which employee opts (has to be local area of applicant);
(iv) seniority will be governed as per existing rules governing seniority on transfers on option basis.
3. The ban orders regarding transfer of employees shall not be applicable to transfers effected in pursuance of these orders, as Para 3(ii) of G.O.Ms.No.154, Finance (W&M) Dept. Dated: 04-07-2007.
4. All the Departments of Secretariat are requested to take necessary action as per the instructions given accordingly.
