Sub: - PUBLIC SERVICES - Creation of supernumerary posts to implement stay orders of High Court against reversion of temporary employees to lower posts for want of vacancies.

In the G.0. first cited orders were issued dispensing with the practice of creating supernumerary posts in respect of those left without posts owing to their juniors securing stay orders of the High Court against their discharge or reversion to the lower posts. The Andhra Pradesh Non-Gazetted Officers Association has represented that the orders in the said G.0. are contrary to the provisions in rule 8 of the State and Subordinate Service Rules and requested that these orders be cancelled.


2. The question has been examined and it has been considered that there is no need to cancel the orders issued in G.O.Ms.No.1224, General Administration (Services-A) Department, dated 20th December, 1971. However, the real remedy lies in getting the stay orders vacated so that the seniors are not put in a disadvantageous position, due to the continuance of their juniors, by virtue of the stay orders obtained by them. I would, therefore, suggest urgent prompt action be taken to get, the stay orders vacated in every case through the Government Pleaders/Advocate-General, as the case may be.
