Sub:  SUITS - Writ Petition filed against implementation orders in G.O.Ms.No.1224, G.A. (Ser-A), dated 20th December 1971 - Regarding.

 

In G.O.Ms.No. 1224, GA. (Ser-A), dated 20th December 1971, orders were issued dispensing with the practice of creating supernumerary posts in respect of those left without posts, owing to their juniors securing stay orders of the High Court against their discharge or reversion to the lower posts. Some of the persons aggrieved by the enforcement of the orders in the said G.O. approached the Court and obtained stay of operation of the orders referred to above. One such Writ Petition is 401/72 in which the High Court quashed the orders issued in G.O.Ms.No. 1224, G.A. (Ser-A), dated 20th December 1971. Against this, the Revenue Department field a Writ Appeal and the Andhra Pradesh High court vacated the stay orders granted in Writ Petition No. 401/72 and finally upheld the orders in the said G.O.

 

2. It is pointed out in this connection that experience has revealed that temporary employees who secure stay orders ft-om the High Court are continued in the posts for long periods by virtue of the stay orders obtained by them against their reversion, discharge etc., and there has been inordinate delay in getting the stay orders vacated as a result of which the seniors who are probationers or approved probationers are put to disadvantage. In order to avoid such a situation, the Departments of Secretariat are requested to take vigorous action to get the stay orders of the High Court vacated at the earliest opportunity and ensure that the Writ Petitions are disposed of expeditiously.
